台灣國際法學會對於俄羅斯聯邦入侵烏克蘭的聲明

俄羅斯聯邦以武力入侵烏克蘭,已違反《聯合國憲章》第2條第4項不得使用威脅或武力,或以與聯合國宗旨不符之任何其他方法,侵害任何會員國或國家之領土完整或政治獨立,臺灣國際法學會嚴厲譴責此種侵略行為。

我們支持聯合國大會在2022年3月2日的決議,要求俄羅斯聯邦立即從烏克蘭撤軍;提醒俄羅斯聯邦應遵守海牙公約體系、日內瓦公約體系在內的國際人道法及國際人權法規範;切實遵守包括核子、生物與化學武器等大規模毀滅性武器的限制規範,任何政治理由並不能免除國際法之法律責任。

我們認為俄羅斯聯邦應遵守歐洲人權法院之臨時措施之要求,不對平民、住宅、教室、醫院等做攻擊,以確保生命權、不受酷刑及家庭權等權利之保障。

我們呼籲雙方採取和平手段解決爭端,遵守國際規範與維護國際秩序穩定,兩國政府應優先處理對於受到武裝衝突影響之平民,立即給予人道教援與安置,立即恢復國際秩序之和平與安全。

我們也注意到每一次軍事衝突對自然與環境造成嚴重影響,土壤、森林、水及空氣都受到污染,留下有毒的遺產,延及子孫後代。當未來和平展開時,必須讓包括環境公民組織在內的民間社會組織參與,以解決衝突造成的生態環境破壞。並且在充分尊重聯合國安全理事會第1325號決議的情況下,納入婦女的平等參與。

Statement on the Russian Federation’s Invasion of Ukraine

 The Russian Federation’s invasion of Ukraine by military forces violates Paragraph 4 Article 2 of the Charter of the United Nations which enshrines that all member states shall refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any state. The Taiwanese Society of International Law strongly condemns such aggression.

 We support the resolution of the United Nations General Assembly of 2 March 2022 calling on the Russian Federation to withdraw its troops from Ukraine immediately, reminding the Russian Federation that it should abide by the norms of international humanitarian and human rights laws, including the Hague Conventions and the Geneva Conventions, and effectively complying with the restrictive norms of weapons of mass destruction, including nuclear, biological, and chemical weapons. No political reason can exempt the Russian Federation from legal liability under international law.

 We believe that the Russian Federation should comply with the requests of the European Court of Human Rights for interim measures and refrain from attacking civilians, homes, classrooms, hospitals, etc., to ensure the protections of the rights to life, freedom from torture and the right to family life.

 We call on both sides to resolve disputes by peaceful means, abide by international norms and maintain the stability of the international order. The two Governments should give priority to the immediate provisions of humanitarian assistance and resettlement to civilians affected by armed conflicts, and to immediately restore international peace and security.

 We also note that every military conflict has a serious impact on nature and the environment of which polluting soils, forests, water, and air leaving behind a toxic legacy will be extended to future generations. We therefore urge that when peace comes, civil society organizations, including environmental organizations, must be included to address the ecological damage caused by conflicts. With full respect for UN Security Council Resolution 1325 equal participation of women should also be fulfilled.
